Charter Ordinance No. 20 (2008)
Charter Ordinance 20 provides for the amendment of the statutory uses of a public building commission (PBC) under the Kansas Public Building Commission Act and eliminates the protest and election procedure for the issuance of revenue bonds under the same enactment. In the State of Kansas, the Constitution provides (Art. 12, Sec. 5) that where enactments of the Legislature are not uniformly applicable to all municipalities, cities may choose to "charter-out" from under the authority or limitations of state law by using a charter ordinance. Charter Ordinance No. 20 is an essential piece of municipal legislation necessary for the affordable and timely construction of a new municipal aquatic recreation facility, which is planned to open by Summer 2009, but has not yet been approved by the City Commission as of February 15, 2008. The City and Public Building Commissions will likely approve the project near May 2008.
